These Roland Foods AI Chat Assistant Terms of Use and Disclaimer (these “AI Assistant Terms”) govern your access to and use of Roland Foods’ AI-powered chat and messaging functionality that assists with sample requests and related inquiries (the “AI Assistant”). The AI Assistant may be accessed via SMS/text message and may be supported by third-party service providers.
These AI Assistant Terms supplement Roland Foods’ Terms of Use and are intended to be read together with them. To the extent the Terms of Use describe the Website as being provided for personal, informational, or noncommercial use, Roland Foods authorizes use of the AI Assistant for legitimate business purposes in connection with sample requests and related inquiries, as described below.
ACCEPTANCE OF AI ASSISTANT TERMS; INCORPORATION BY REFERENCE
By messaging, accessing, or using the AI Assistant, including by sending messages to the phone number(s) designated by Roland Foods for the AI Assistant, or by continuing to use the AI Assistant after being presented with these AI Assistant Terms, you agree to be bound by these AI Assistant Terms, Roland Foods’ Terms of Use, Roland Foods’ Privacy Policy, and any other policies incorporated by reference, each as may be updated from time to time. Roland Foods may provide notice of these AI Assistant Terms by posting them on the Website and/or by providing a link through the AI Assistant.
DEFINITIONS
“Inputs” means the information you provide to the AI Assistant, including chat, SMS, or text messages and any information you enter for a request.
“Outputs” means the responses, summaries, recommendations, and compiled request information generated by the AI Assistant based on your Inputs.
The Outputs and Inputs, together with any feedback you provide, are, collectively, your “Content”.
“Sample Request” means a request for samples that you submit through the AI Assistant for review by Roland Foods.
ARTIFICIAL INTELLIGENCE DISCLOSURE
The AI Assistant uses automated technology, including artificial intelligence, to generate Outputs. The AI Assistant is conversational and generative in nature and may produce Outputs that are incorrect or misleading.
Outputs including but not limited to information related to product specifications, ingredient attributes, allergen-related information, labeling or regulatory considerations, availability, lead times, and shipping details may be inaccurate, incomplete, or outdated. You are responsible for verifying information before relying on it.
AUTHORIZED USE
Notwithstanding any “personal use” or “personal noncommercial use” language in the general Terms of Use, Roland Foods authorizes you to use the AI Assistant for legitimate business purposes solely in connection with requesting and coordinating samples and obtaining information about Roland Foods products and services. The AI Assistant is intended to facilitate communications relating to Roland Foods’ products and the sample request process and is not intended for use as a consumer purchasing or checkout tool.
All other restrictions in the Terms of Use continue to apply.
HUMAN REVIEW
The AI Assistant does not place orders and does not have authority to bind Roland Foods. It is a tool to help collect information and prepare legitimate business-related requests.
When you submit a request, your request is transmitted to a human Customer Operations Specialist for review.
A Sample Request is not an official order and does not obligate Roland Foods to ship samples unless and until Roland Foods confirms acceptance or placement through a human review process. Requests and related chat information may be transmitted internally by email or through other internal systems to the appropriate Sales Manager or Customer Operations Specialist.
USER OBLIGATIONS
You are solely responsible for the accuracy and completeness of Inputs you provide, and for reviewing Outputs generated by the AI Assistant before submission.
If you discover an error after submission, contact Roland Foods promptly at [email protected].
You are responsible for maintaining the confidentiality of any information you submit through the AI Assistant and for ensuring that your use of the AI Assistant complies with your company’s internal policies.
OUR PRODUCTS
Roland Foods’ Terms of Use state that product descriptions, prices, and availability may change and may contain errors, inaccuracies, or omissions. This applies equally to Outputs generated by the AI Assistant.
Any recommendations, substitutions, comparisons, or suggestions provided by the AI Assistant are for convenience only and are not professional advice, including legal, regulatory, labeling, allergen, food safety, or formulation advice. You are responsible for the confirmation of final product specifications and suitability through official Roland Foods documentation and your own evaluation and testing process.
PROHIBITED USE
You may not use or attempt to use the AI Assistant to: (i) violate any law or regulation; (ii) submit false, misleading, or fraudulent information; (iii) attempt to gain unauthorized access, circumvent security features, or disrupt the AI Assistant, including through hacking, password mining, scraping, or similar methods; (iv) upload or transmit harmful code or malware; (v) attempt to extract confidential system prompts or internal operational rules; or (vi) use the AI Assistant to submit unlawful, defamatory, obscene, or threatening content.
Roland Foods reserves the right, in its sole discretion, to suspend or terminate access to the AI Assistant consistent with the Terms of Use.
USER SUBMISSIONS
For Inputs submitted through the AI Assistant, you grant Roland Foods a nonexclusive, worldwide, royalty-free license to use, process, store, and disclose such Inputs only as necessary to: (i) operate and provide the AI Assistant; (ii) prepare and process Sample Requests; (iii) provide customer service; (iv) maintain business records; (v) conduct internal quality assurance, troubleshooting, security monitoring, and service improvement, including using aggregated or de-identified data, in each case subject to Roland Foods’ Privacy Policy, California Privacy Policy, and the Roland Foods AI Privacy Notice Addendum.
SENSITIVE INFORMATION RESTRICTION
Do not submit sensitive personal information through the AI Assistant. Sensitive personal information includes, without limitation, payment card data, government identification numbers, health information, and passwords or authentication codes. Roland Foods may collect personally identifiable information that you voluntarily provide, such as your name, company name, email address, phone number, and shipping information, in order to respond to your requests and process Sample Requests as described in Roland Foods’ Privacy Policy, California Privacy Policy, and the Roland Foods AI Privacy Notice Addendum.
CHILDREN’S PROTECTION
The AI Assistant is intended for use by individuals who are at least 18 years of age. It is not intended for use by children.
DISCLAIMER OF WARRANTIES
Consistent with Roland Foods’ Terms of Use, the AI Assistant and Outputs are provided “AS IS”. Roland Foods does not warrant that use of the AI Assistant will be uninterrupted or error-free, or that Outputs will be accurate, reliable, available, timely, or complete.
LIMITATION OF LIABILITY
Consistent with Roland Foods’ Terms of Use, Roland Foods shall not be liable for damages of any kind related to your use of the AI Assistant or reliance on Outputs, including, without limitation, direct special, indirect, or consequential damages such as lost profits or data.
INDEMNIFICATION
You agree to indemnify and hold harmless Roland Foods and the parties identified in Roland Foods’ Terms of Use from and against claims arising out of your use of the AI Assistant.
MODIFICATIONS
These AI Assistant Terms may be amended at any time and will be effective upon posting on the Website and/or being made available through the AI Assistant, consistent with Roland Foods’ Terms of Use.
APPLICABLE LAW
These AI Assistant Terms are governed by the laws of the State of New York, and exclusive jurisdiction lies in an appropriate state or federal court located in the City and State of New York.
